California Vehicle Code Section 9951
As of July 1, 2004, California passed a law attempting to require the registered vehicle owner's consent,
or a court order, for an EDR to be downloaded. This is the full text of Assembly
Bill 213 that was signed by the governor.

Protocols for the Recovery, Maintenance and
Presentation of Motor Vehicle Event Data Recorder Evidence (06/03)
The
recovery and presentation of electronic data requires procedures that assure
the
information presented is an accurate record of the data stored on the
computer chip and
that the data was not altered or lost due to mishandling. This protocol,
based on U.S. Dept. of
Justice standards for handling digital evidence,
has been written to provide a means of being
reasonably certain that data held as coming from
an EDR is an accurate representation, that
data access and recovery was authorized and
that recovered data is afforded protection from
an inadvertent release. These procedures provide that documentation must be such that
in the
absence of the originator, another competent person can evaluate what was done and
interpret the data.
